White Plains, NY, June 4 -- Walter H Young of New Rochelle, referee in the divorce action brought by Edna Valentine Trapnell, has filed a report in the Supreme Court in which he reports to the court that the complaint should be dismissed.
The couple were married on Feb. 20, 1909, at Brookhaven, L.I. The defendant interposed a denial of misconduct.
Referee Young says that only one witness was called by the plaintiff before him as to the misconduct of the defendant. This witness was Alfred S. Willitt, who, the referee finds, was a party to the alleged misconduct and willingly furnished evidence to the plaintiff’s attorney.
“In my opinion,” says the referee, “the allegations of the complaint were insufficient, and the complaint should be dismissed.”
