On this 2 day of August Ad 1887 Chas W Whitten filed complaint charging G C Rue assaut & battery by unlawfully and willfully hit beat and strike and bruise one M Wilson.
August 2: Warrant returned served by bringing G C Rue in to court before me and being informed of his rights and the charge being read to him he plead not guilty. Trial set for 3rd day of August 1887 at 10 o'clock a.m. Subpoena issued for def and plaintiff.
August 3: 11 o'clock a.m. court adjourned until 1 o'clock pm. The hour of hearing having arrived and all the parties being present in court witness called for plaintiff and sworn John Lowe Dan Harrington. Plaintiff rest. Defendant call A D Herrich(sp) case having been taken under advisement until 4 o'clock p.m. this 3rd day of August 1887. Whereupon it is ordered and adjudged that G C Rue the Def for such his offense of Battery pay as fine of ten dollars $10.00 and in case said fine be not paid by 10 o'clock this 3rd day of August 1887 that the Def be imprisoned until the fine be duly satisfied in the proportion of one days imprisonment for every one dollar of fine and in the payment of such portion of said fine as shall not have been duly satisfied by imprisonment at the rate above prescribed that the Def be discharged from custody.
